FINAL IMAGES: PRINTING, SHARING AND RECEIVING

Exceptional to the Monetary Gain & Commercial Use policy, adult industry workers may use images for printed magnets, posters, lighters and stickers to be sold or given out at adult clubs and entertainment establishments. ​Monetary gain may ONLY be acquired from the sharing or sale of the images on adult content based platforms such as Frisk, Only Fans, etc for posts and PPV messages. You may use images for promotional items such as posters, lighters, magnets, stickers, etc. You may also use images for advertisements and promotions such as posters and on social media. Please credit Studio Nova as your photographer when you are able. IMAGE SHARING
Client acknowledges that all images will remain private unless otherwise agreed upon. THE CLIENT will receive model release options with their gallery. THE CLIENT acknowledges that THE PHOTOGRAPHER will not be held responsible for the final destination of the images if permission is given to share them for promotional purposes, including but not limited to social media platforms and studionovacanada.com. Content sessions require that you sign a full release form for all images taken during the session.

PRINTING IMAGES
Final images given to clients via an online gallery are able to be downloaded to your device/computer. Images are high-resolution, and will appear high quality in print. If you wish to print your images, please contact Studio NOVA for a list or products, or ask us about something specific you have in mind, or print yourself. SEE STUDIO NOVA PRINTING OPTIONS HERE

CREATIVE FREEDOM

THE CLIENT agrees that the photos received have been edited at the discretion of THE PHOTOGRAPHER. Any extra editing requests are subject to a service charge and at the discretion of THE PHOTOGRAPHER with right of refusal. It is at the discretion of THE PHOTOGRAPHER to not include a photo if it is not up to self-defined technical standards. THE PHOTOGRAPHER possesses final creative control over all final images including, but not limited to, retouching, black and white filters, contrast levels, and all other editing decisions. If you wish to request any changes, there will be $10+ editing fee per image, should THE PHOTOGRAPHER decide to make the change. No alterations, including but not limited to skin retouching, cropping, face-tuning, colour changes, filters from apps, and any other changes may not be applied to final images. Images are to remain unaltered by the client at all times.

ADDITIONAL EDITING

THE CLIENT agrees that an extra fee of $10+ per image applies for additional editing work, including but not limited to, tan lines (including those from outdoor tanning, tanning beds and spray tans), tattoo removal, and other additional requests made by the client. THE PHOTOGRAPHER will not take requests to alter body parts/sizes, and will only edit things like blemishes, colour correcting, bruises, and other items that could also be altered with just makeup. THE PHOTOGRAPHER will not do any editing to make your body appear a different shape or size.

DIGITAL MANIPULATION:

No alterations, including but not limited to skin retouching, cropping, face-tuning, colour changes, filters from apps, and any other changes may not be applied to final images. Images are to remain unaltered by the client at all times.

OWNERSHIP OF IMAGES/COPYRITES/CLIENT USE

The photographs produced by THE PHOTOGRAPHER are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without studio explicit written permission. It is a breach of this contract to reproduce the images in any form unless rights were purchased within the package for those images. It is in breach of copyright law to edit these images in any way, this includes but is not limited to popular social media filters and special effects. No alterations, including but not limited to skin retouching, cropping, face-tuning, colour changes, filters from apps, and any other changes may not be applied to final images. Images are to remain unaltered by the client at all times. Client reserves the right to post purchased images on social networking sites such as Instagram, Facebook and Twitter. MONETARY GAIN FROM IMAGES:

Monetary Gain & Commercial Use: Commercial use of these photos is prohibited. These images are for personal use only, and may be reproduced for the purpose of sharing with friends and family. In the event that these photos will be published, sold for profit or used within marketing materials, the client must obtain written permission from and compensate THE PHOTOGRAPHER prior to the release. An additional contract will be needed at that time.

SOURCING OF IMAGES:

Images must be sourced at all times. You may post images on sites including, but not limited to; OnlyFans, Facebook, Twitter, Instagram, social forums, Pinterest and/or through use in emails and agrees that he/she will credit Studio NOVA every time he/she does so. Images posted to any online media platforms that are not sourced will be reported to the site and removed. Repeated failure to properly source images will result in legal action.

RAW OR UNEDITED IMAGES

We never provide unedited images in any situation. All images are edited to Studio NOVA;s standards, and best reflect our work the way we would like for it to be seen. Please do not request unedited images.

YOUR BOOKING

DEPOSIT:

THE CLIENT agrees that the paid deposit is non-refundable/non-transferable. The retainer is due in order to hold a reservation/date with THE PHOTOGRAPHER. Any change of date requires written agreement between THE CLIENT and THE PHOTOGRAPHER. THE CLIENT agrees that in the event of a cancellation within 6 days of their session, that the initial contract and retainer become void and that THE CLIENT is subject to the most current pricing options if they chose to rebook their date.

EXPECTATIONS

THE PHOTOGRAPHER is a professional and shoots in a professional manner. THE CLIENT agrees that he/she will in no way hold THE PHOTOGRAPHER responsible or liable for sexual inappropriateness. Boudoir photography, by definition, may include nude, semi nude, sexual or suggestive poses. You will be photographed wearing little and/or no clothing. You understand what a Boudoir Photography Session is, and are booking in full competency, without being coerced, influenced. You must be 18 years or older.  Due to the nature of the session a strict timeline will be enforced to ensure the package obligations are met. The session will start at the scheduled start time even if THE CLIENT is tardy or unprepared. The session end time will remain the same. If additional time is needed, THE CLIENT will have the option to purchase based off the online pricing menu for additional time. The same applies for outfit changes; changing from one outfit to another does count towards the total amount of the session time. THE CLIENT is responsible for providing any personal outfits that are to be used within the session. THE PHOTOGRAPHER will not be held responsible for additional sessions needed due to forgotten items. There are additional fees for the following: added time, additional outfit changes, any products/ prints/services not specified in the package purchased.

ADDITIONAL GUESTS

he client acknowledged that they will come to their session on their own and that there is no space or waiting room for a guest unless previously discussed. THE PHOTOGRAPHER will only allow limited guests on a case-by-case basis. If they wish to be dropped off by a guest, THE PHOTOGRAPHER can provide suggestions of nearby services for the guest to wait.

POSES:

Posing: THE CLIENT understands that a Boudoir Photography Session may require certain movement and physical activity. THE CLIENT will let the photographer know prior to the session date if he/she may struggle to follow some movement requests and/or is disabled or injured, so THE PHOTOGRAPHER can modify poses. If THE CLIENT has any questions or concerns about these requirements, we will discuss.  THE CLIENT agrees that the level of nudity she shows during the Boudoir Photography Session is at her own discretion. THE CLIENT agrees that she will not do anything she is uncomfortable with and will speak up at the time if uncomfortable with a certain level of nudity or a pose.

RESCHEDULING/CANCELLATION POLICY

Any cancellation must be in writing.  No monetary reimbursement will be provided (deposit, GST, and processing fee will NOT be refunded). Your non-refundable deposit will not roll over to a rescheduled date. Cancellation will result in the client forfeiting all monies paid. Case by case exceptions may be made at the discretion of THE PHOTOGRAPHER. THE CLIENT agrees that should they request to reschedule their session within 1 week of the session, THE CLIENT will be required to pay a $50+GST re-scheduling fee. THE CLIENT agrees that should they request to reschedule their session within 6 days of the session will be required to pay a new deposit to reschedule. The CLIENT acknowledges that if they booked their session on a promotion that had a limited date range that any reschedules outside of that date range are subject to regular pricing. The CLIENT  acknowledges that any amount paid towards the session will be kept as credit towards a new session date, and that this credit must be used within 6 months of the cancellation date. THE CLIENT agrees that in the event of a cancellation within 6 days of their session, that the initial contract and retainer become void and that THE CLIENT is subject to the most current pricing options if they chose to rebook their date. THE CLIENT agrees that in the event that THE PHOTOGRAPHER cancels the session for any reason, including but not limited to; medical emergency, family emergency, inclement weather, road closures, natural disaster, closure of venue, or similar catastrophe, THE PHOTOGRAPHER will refund deposits, as well as any payments made. You will first be given the option to reschedule with no fee.

OUTDOOR SESSIONS

If there is poor weather for your outdoor session, you are given the option to reschedule with no fee. If rescheduling is not possible, any amount paid towards the session will be kept as credit towards a new session date, and this credit must be used within 6 months of the original session date. Your same package, image amount and price will remain the same. If we are unable to do an outdoor session, you can book a studio session for the same rate instead.

LATE ARRIVAL POLICY

Clients are urged to adhere to scheduled session times, as delays may impact subsequent appointments. The session will start at the scheduled start time even if THE CLIENT is tardy or unprepared. The session end time will remain the same. If additional time is needed, THE CLIENT will have the option to purchase based off the online pricing menu for additional time. If THE CLIENT is more than 15 minutes late for the appointment, a new appointment will need to be scheduled, with a new $150+GST deposit. Other payments made towards THE CLIENT’s session will be kept as credit towards a new session date.

PHOTOGRAPHER CANCELLING YOUR SESSION

Studio NOVA will refund deposits, as well as any payments made, should the photographer need to cancel your session for any reason.You will first be given the option to reschedule.

PAYMENTS​ AND INSTALMENTS ​

A signed contract and the retainer deposit (+GST) are required to book the boudoir session. The booking deposit is due at booking and is required to hold the date and time.  The remainder of the amount is due 24 hours prior to the scheduled session. THE PHOTOGRAPHER reserves the right to refuse services/products if the payment arrangements have not been met unless a prior payment plan has been made.

PACKAGE AND ADD ONS

THE CLIENT agrees that he/she may add additional items at any time to his/her Contract, subject to current pricing, but may not remove items from the Contract once it has been signed. THE CLIENT understands that he/she is responsible for paying for the items selected on the Contract. If THE CLIENT fails to pay for selected items, THE PHOTOGRAPHER does not have to provide THE CLIENT with any images or monetary compensation for monies paid. 

DELIVERY & TIMELINE

THE PHOTOGRAPHER will provide an online proof gallery to THE CLIENT’s email within 7 days of the session date. THE CLIENT then has 7 DAYS to submit photo choices to THE PHOTOGRAPHER. Once images are selected, THE PHOTOGRAPHER will deliver final images within 14 days of the selection date. The client acknowledges that expected production time between selection date and product (albums and printed items) delivery is up to 4 weeks. THE CLIENT agrees that it is their responsibility to provide THE PHOTOGRAPHER with a special event date and that all rush orders are to be discussed at time of booking. THE CLIENT agrees that album layouts are designed by THE PHOTOGRAPHER .  Final images given to THE CLIENT via an online gallery are able to be downloaded to THE CLIENT’s device/computer. Images are high-resolution, and will appear high quality in print.

IMAGE SELECTION

THE CLIENT agrees that they have 7 DAYS to submit photo choices to THE PHOTOGRAPHER. After 7 Days the client agrees to pay a $25 gallery extension fee for 5 additional days. The client agrees that upon submitting their photo choices that these are their final photo choices and due the nature of retouching photo choices can not be changed after final edits and album design process have commenced. In the event the client wishes to change photo choices they will be subject to additional fees. In the event that the client downloads or posts their proof images watermarked “do not screenshot”, legal action will be taken. Watermark will not appear on final downloaded images.

CLIENT CLOSET

THE CLIENT agrees that they are responsible for providing personal lingerie to be worn, and that THE PHOTOGRAPHER only provides optional pieces from the Client Closet based on what is currently available at the time of THE CLIENT's session. THE PHOTOGRAPHER has a limited Client Closet available for client use. The client closet is limited in sizes, colors and styles. THE PHOTOGRAPHER does not guarantee that any one item will be available for use on clients session day. THE CLIENT acknowledges that items are sanitized between use but they are voluntarily wearing items in the closet. THE CLIENT  acknowledges that the client closet is meant to supplement clients own shopping and not act as a full client wardrobe for their session. The client acknowledges that there is no guarantee that any specific client closet item previously seen on social media or online will be made available for their session. The client agrees that if said clothing is damaged or torn that THE PHOTOGRAPHER will not be held responsible or expected to retouch damage in the photographs.

SHIPPING

THE CLIENT agrees that a charge is applicable if they request to have products/items shipped. This fee applies for each time that THE CLIENT requires a subsequent item be mailed and payment is due prior to item(s) being shipped. The cost for shipping items is $10-$40CAD. THE CLIENT agrees that THE PHOTOGRAPHER shall not be held responsible for items lost, misplaced or delivered to the wrong address by courier. The client acknowledges that THE PHOTOGRAPHER is not in any way affiliated and/or in control of product/album couriers. THE CLIENT agrees that in the event the courier misplaces their product or album that THE PHOTOGRAPHER will replace the product at no additional cost to the client. The client agrees that THE PHOTOGRAPHER will not be held liable for items lost or misplaced by the courier.

ALBUM AND PRINT QUALITY

THE CLIENT agrees that they must view and approve the state of the products upon pickup. If there are any manufacturer defects, THE CLIENT agrees to mention them at pick up.. THE CLIENT agrees that THE PHOTOGRAPHER and Third Party supplier are not at fault if the defect is self- inflicted by THE CLIENT or if they have not properly cared for the products or has caused purposeful damage in any way. Repair will not be covered for reasons including, but not limited to; if THE CLIENT has torn a page, dented the cover, broken the spine, spilled any items on the products or generally mistreated it. THE CLIENT agrees that if she is submitting the products back to THE PHOTOGRAPHER with a manufacturers' defect that the layout will not be changed in any way. Only the defect will be repaired.

PRIVACY POLICY

THE CLIENT agrees that all information and documents given to him/her are the exclusive property of THE PHOTOGRAPHER and are confidential information. They may not be sold, shared or copied.

PRICING DISCLAIMER

If you would like to purchase additional products or prints, these products will be offered when you view your proof gallery. Prices sent with the proof gallery are guaranteed for 30 days. The client acknowledges that if they wish to buy products after 30 days that prices may increase.  This contract solidifies the package contents and the price at the time of booking. This contract is specifically for services and products purchased on purchase date. 

IMAGE STORAGE

THE CLIENT agrees that they must back up the digital images once received. THE PHOTOGRAPHER only guarantees a one year back up of images and is not responsible for the storage of the images after one year. THE CLIENT agrees that THE PHOTOGRAPHER is not responsible for updating the files as technology advances. THE CLIENT agrees that if they lose their images or backup once THE PHOTOGRAPHER has delivered their images there will be no reshoot or monetary value provided as THE PHOTOGRAPHER has fulfilled the terms of the shoot agreement.
